General Terms

These terms and conditions (the ‘Rules’) apply to the proof of purchase based competition and prize draw that, together, constitute the “Rocco Forte Collection Travel Trade Suite Competition” (the ‘Competition’). By entering the Competition, entrants agree to be bound by these Rules.

The Competition is organised by Rocco Forte & Family (Hotel Management) Limited (The Rocco Forte Collection) a company incorporated in England and Wales under registered number 4045930 and whose registered office is at 70 Jermyn Street London, SW1Y 6NY.

To qualify in the Prize Draw, entrants must book a reservation in a suite room at three different hotels in The Rocco Forte Collection. The booking must be made between the period of 8am on 1st May 2008 to 11.59pm on 15th October 2008 (the ‘Term’). The Rocco Forte Collection reserves the right to cancel or amend the Competition or these Rules at any time without prior notice.

In the event of any dispute regarding the Rules, conduct, results and all other matters relating to the Competition, the decision of The Rocco Forte Collection shall be final and no correspondence or discussion shall be entered into.

Procedure

Entrants booking a suite room at three different hotels in The Rocco Forte Collection will qualify for one entry in the Competition.  Entrants will need to visit www.rfctraveltrade.com and submit details of their booking and their personal details to enter the Prize Draw.  

There will be 11 winners. Subject to the Rules, each winner of The Rocco Forte Collection Travel Trade Suite Prize Draw will receive a voucher for one 3-night stay for two in a Rocco Forte Collection suite with one return econonmy class flight (the ‘Voucher’).

The 11 winners will be picked separately. The first draw will take place on or around 20th October 2008. The remaining draws will take place between the 20th and 24th October 2008. Each draw in The Rocco Forte Collection Travel Trade Suite Prize Draw will be conducted electronically in front of an independent person using specific software.

All winners will also be notified directly, by email by The Rocco Forte Collection. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and the selection of an alternative winner.




Qualifying Entrants 

To qualify to enter the Competition entrants must be IATA registered travel agents aged 18 or over. All entrants must register to participate in the Competition using their email address, hotel name and booking reference number for the three suite bookings they made on www.rfctraveltrade.com

If a travel agent books a suite at more than three hotels, each set of three qualifies the agent for another entry into the Competition – providing each hotel between the sets of three are different.

Employees of The Rocco Forte Collection or any company involved in the Competition or any advertising agency or web company connected with The Rocco Forte Collection or any such person’s subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the Competition.  The Rocco Forte Collection reserves the right to verify the eligibility of all entrants.

By entering the Competition, entrants hereby warrant that all information submitted by them is true, current and complete.

The Rocco Forte Collection assumes that by entering the Competition (and entrants warrant that) they have legal capacity to enter the Competition and agree to the Rules.

Competition entries must be made in accordance with these Rules.  Failure to do so will disqualify the entry. The Rocco Forte Collection reserves the right to disqualify any entrant if it believes that the entrant has breached any of these Rules or that some other improper action or omission has been taken by or on behalf of any entrant. 

The Rocco Forte Collection does not accept responsibility for ineligible entries or entries made fraudulently.

Restrictions 

Winners shall be entitled to use their Voucher from the date on which the prize is awarded until (before and including) 31st December 2009.

The Vouchers are awarded at The Rocco Forte Collections’ discretion and the right to utilise the Vouchers is subject to availability and the Vouchers shall be used at a location to be agreed with The Rocco Forte Collection whose decision shall be final. The Vouchers may not be utilised during peak times, which shall be determined by The Rocco Forte Collection at its sole discretion. All insurances, meals, beverages, visas, spending money and any other expenses are the sole responsibility of the prize winner.

A Voucher cannot be divided into parts.  This means that if a Voucher is used for a period of less than 3 consecutive nights during the Term, the remainder of the entitlement in that Voucher shall be void and may not be used in the same calendar year or carried forward to another calendar year.

In addition to, or as an alternative to the Vouchers, The Rocco Forte Collection may offer such other prizes, as it shall in its sole discretion determine, and The Rocco Forte Collection reserves the right to substitute prizes of equal, greater or less value at any time.

Each Voucher is personal to the winner who won it and must not be sold, assigned, auctioned, transferred or otherwise disposed of without the prior written consent of The Rocco Forte Collection.  There is no cash alternative to the Vouchers and they cannot be exchanged for other goods or services save by The Rocco Forte Collection as provided above.  The Vouchers cannot be combined or used in conjunction with any other discount or offer.

Any change in the perceived value of the prizes occurring between publishing date and date of the prizes are claimed is not the responsibility of The Rocco Forte Collection.

Intellectual Property Rights 

Any information submitted by any entrant must be personal to him/her or his/her travel agency.  Entrants hereby warrant that the information which they submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.  If relevant, The Rocco Forte Collection reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.

Data Protection and Right of Publicity 

Entrants are required, when submitting their entries, to provide certain basic personal information including without limitation his/her name, surname, work email address, work telephone number and certain other information such as the address of his/her travel agency (the ‘Personal Information’)

By taking part in the Competition, winners accept that The Rocco Forte Collection reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity. Winners also agree to comply with any reasonable request from The Rocco Forte Collection to take part in the promotional activities of The Rocco Forte Collection in connection with the Competition.

Each entrant agrees that The Rocco Forte Collection may use the Personal Information for the purpose of sending him/her free email newsletters and contacting him/her by email, post and telephone with promotional offers and generally information about its services and activities. Each entrant further agrees that the Personal Information may be transferred to other companies within the The Rocco Forte Collection group of companies or to carefully selected external third parties engaged by The Rocco Forte Collection.

Each entrant agrees that the Personal Information may, for the above purposes, be transferred outside the European Economic Area ("EEA") to jurisdictions that do not offer the same level of protection through their data protection legislation as that offered in the EEA.

Liability 

The Rocco Forte Collection cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition. The Rocco Forte Collection accepts no responsibility for any technical malfunction or problems of its systems, software failure, traffic congestion on the Internet or for any damage to entrant or to any other person related to or resulting from the entrant’s participation in the Competition.  Nothing shall exclude The Rocco Forte Collection’s liability for death or personal injury as a result of its negligence.

Governing Language 

These Rules are drawn up in the English language. For convenience only, these Rules may be translated into other languages, however, the English text shall prevail.

Jurisdiction 

The Competition and these Rules shall be governed by the laws of England and Wales and the English courts shall have exclusive jurisdiction over any dispute arising out the Competition or theses Rules.
